Session overview

This session will assess how the EU cryptoasset framework and requirements for cryptoasset service providers (CASPs) should evolve following the first phase of MiCA implementation and in light of the issues raised in the EU Commission’s 2026 MiCA review consultation and the MISP proposals regarding CASP supervision.

Points of discussion

1. MiCA cryptoasset requirements

Following the first phase of MiCA implementation and in light of the issues raised in the 2026 MiCA review consultation, what are the main priorities for adjusting, clarifying or simplifying MiCA cryptoasset requirements? Are changes or additional safeguards needed for ART and EMT rules, the requirements applying to other cryptoassets, and activities or products that are outside or only partly covered by MiCA?

2. CASP regulation and supervision

What benefits could the MISP proposal to transfer CASP supervision to ESMA bring in addressing the cross-border nature of CASP activities and supporting the MiCA passport, and what challenges remain to be addressed? Should alternative supervisory approaches be considered for certain CASPs? As CASP activities and business models evolve, which MiCA requirements may need to be clarified, completed or adjusted in light of the Commission’s consultation on the MiCA review?
